Maine state law: brush clearance and defensible space

Maine has no statewide statute mandating a defensible-space brush-clearance distance on residential parcels. Maine Forest Service operates the FireWise Communities USA program in partnership with the National Fire Protection Association under 12 MRS Chapter 805, providing voluntary best-practice guidance for a 30-foot home-ignition-zone clearance (Zone 1: 0-5 ft hardscape and noncombustible materials; Zone 2: 5-30 ft thinned and pruned vegetation; Zone 3: 30-100 ft fuel reduction). Compliance with FireWise is NOT mandatory and is not a permit condition. Where defensible-space clearance intersects the mandatory Shoreland Zone (every Maine municipality must enforce shoreland zoning within 250 ft of great ponds, rivers, freshwater wetlands, and tidal waters per 38 MRS § 435), clearance is CONSTRAINED by the 75-ft setback and minimum-vegetation-buffer rules of the state Shoreland Zoning Standards (38 MRS § 439-A and DEP Chapter 1000). Within the 75-ft buffer, a property owner may NOT clear-cut and must follow the DEP point-system rules limiting removal to a 25-foot-square-segment basis with up to 40% of trees over a 10-year period. A homeowner seeking to create defensible space within the buffer requires a Maine DEP shoreland-zoning variance. The Unorganized Territory (most of northern and western Maine) is regulated by the Land Use Planning Commission (LUPC) under 12 MRS § 685-A et seq., which administers its own forest-practice and clearance standards.

Failure to clear brush has NO state-law penalty outside the Shoreland Zone. Unauthorized clearing WITHIN the Shoreland Zone is a civil violation under 38 MRS § 349 with fines of $100-$25,000 per day plus restoration order. Local municipal property-maintenance ordinances may impose tall-grass/brush fines ($25-$500 typical).
