Maine state law: residential pool fencing requirements

Maine has no separately codified residential pool fencing statute. Fencing requirements are imposed through the Maine Uniform Building and Energy Code (MUBEC) under 25 MRS § 2451, mandatory in municipalities of 4,000+ population. MUBEC adopts by reference the International Residential Code (IRC) Appendix G and the International Swimming Pool and Spa Code (ISPSC). Required for all pools, spas, and hot tubs holding 24 inches or more of water: (1) barrier at least 48 inches high measured from the side facing away from the pool; (2) maximum 4 inches between vertical members (1¾ inches between horizontal members in climbable designs); (3) maximum 2 inches between the bottom of the barrier and the ground (or 4 inches on a solid surface like a deck); (4) self-closing and self-latching gates with the latch release a minimum of 54 inches above grade, opening outward away from the pool; (5) an isolation fence separating the pool area from the dwelling, OR pool alarms and/or self-closing self-latching doors on all dwelling doors providing direct access. Enforced at building-permit issuance and final inspection by the local code-enforcement officer. Above-ground pools where the pool wall itself is 48+ inches high may use the pool wall as the barrier, with a removable or lockable ladder. ASTM F1346 safety covers may substitute for the barrier on spas and hot tubs.

A pool without a compliant barrier will not pass MUBEC final inspection and will not receive a Certificate of Occupancy. Operating a non-compliant pool triggers municipal civil penalties up to $2,500/day under 30-A MRS § 4452. Independent premises-liability exposure under common-law negligence and the attractive-nuisance doctrine applies.
