Summary

Maine prohibits the sale of tobacco and electronic smoking devices to anyone under age 21 under 22 MRS section 1551-A and related Tobacco 21 statutes.

2. (TEXT EFFECTIVE 1/05/26) Sales to persons who have not attained 21 years of age prohibited. A person may not sell or furnish, or offer to sell or furnish, a tobacco product to any person who has not attained 21 years of age, unless the person has attained 18 years of age as of July 1, 2018. Tobacco products may not be sold at retail to any person who has not attained 30 years of age unless the seller first verifies that person's age by means of reliable photographic identification containing the person's date of birth. That a person appeared to be 30 years of age or older does not constitute a defense to a violation of this section.

Full Breakdown

Maine raised the legal sales age for tobacco products and electronic smoking devices to 21 in 2018 ahead of federal Tobacco 21. Under 22 MRS section 1551-A, retailers must verify a government-issued photo ID for any purchaser appearing under 30. The law applies to cigarettes, cigars, smokeless tobacco, vape devices, and e-liquid. Sampling and free distribution to minors are prohibited. Repeat violations trigger graduated civil penalties and potential license suspension by Maine Revenue Services.

Violations & Penalties

Selling tobacco to a person under 21 results in civil penalties starting at $300, increasing for repeat offenses, and may lead to license suspension.
