Maine Flavored Tobacco Restrictions and Local Authority

While Title 22 chapter 263 sets statewide tobacco licensing standards, Maine permits municipalities to enact stricter local rules on flavored tobacco product sales as a matter of public health. Towns including Portland, Bangor, Brunswick, and South Portland have passed ordinances banning or restricting sales of flavored tobacco and vape products. Retailers in covered municipalities must remove restricted products and update inventory. The Maine CDC supports local Tobacco 21 and flavor enforcement and tracks municipal ordinance adoption statewide.

Local violations carry municipal civil fines, often $100 to $1,500 per offense, and may threaten state tobacco retail licensure if patterns of noncompliance occur.
