Massachusetts Tobacco 21 Age Restrictions Statewide

Massachusetts raised the minimum tobacco purchase age to 21 in 2018, ahead of federal action, and codified the rule in MGL Chapter 270 Section 6. The law applies to all tobacco products including cigarettes, cigars, smokeless tobacco, e-cigarettes, vape pens, and nicotine pouches. Retailers must verify ID for any purchaser appearing under 30. Pharmacies and healthcare facilities are entirely prohibited from selling tobacco products. Cities and towns may impose additional restrictions, such as flavor bans on combustible products or stricter retailer caps.

First offense sales to underage purchasers carry $1,000 fines, with $2,000 for second offense and license suspension or revocation for repeated violations.
