Michigan Tobacco 21 — State + Federal Floor

PA 17 of 2019 amended the Youth Tobacco Act (MCL §722.641 et seq.) to raise the minimum age for sale, purchase, possession, or use of tobacco and vapor products from 18 to 21, mirroring the December 2019 federal Tobacco 21 law. PA 90 of 2020 clarified retailer compliance and ID verification. MDHHS Tobacco Section conducts compliance checks alongside the FDA. Retailers must verify ID for any buyer reasonably appearing younger than 27. Sale, gift, or furnishing to a person under 21 is a misdemeanor. Local governments may add licensing requirements but Michigan has no statewide flavor ban.

Retailer civil fines start at $100 for a first violation and escalate to $500+ for repeats within a 12-month window, plus possible suspension of Tobacco Products Tax Act licenses. Furnishing to a minor is a misdemeanor under MCL §722.641.
