Minnesota Adult-Use Cannabis Home Cultivation Rights

Under the 2023 Cannabis Act (Chapter 342), an adult 21 or older may grow up to eight cannabis plants for personal use at their primary residence, with no more than four flowering at any time. Plants must be in an enclosed, locked space not visible to the public from a public place. Only one residence in the state may be used by any single individual, and only one such operation per residence regardless of number of adults. Local governments cannot prohibit personal home cultivation but may regulate odor, ventilation, and visibility through generally applicable nuisance rules. Selling home-grown cannabis without a license remains illegal.

Exceeding plant limits, public visibility, or selling home-grown cannabis without a license can be a misdemeanor or gross misdemeanor under Chapter 342, plus seizure of plants.
