Minnesota Solar Access and Permitting Preemption

Minnesota supports solar access through several statutes. Section 462.357 subd. 1 authorizes municipalities to regulate access to direct sunlight for solar energy systems as part of zoning. Section 500.216 bars homeowners associations from prohibiting roof-mounted solar on qualifying single-family homes, and section 500.30 creates recordable solar easements. Permitting remains local under the State Building Code, and cities cannot impose aesthetic-only bans. Electrical permits are required under Minn. Stat. 326B.31 using NEC standards. Net metering for systems up to 1 megawatt is required from regulated utilities under Minn. Stat. 216B.164, crediting excess generation.

Unreasonable local solar bans may be challenged in district court. Installing a solar system without electrical or building permits triggers stop-work orders and double permit fees.
