Minnesota Local Flavored Tobacco Bans and State Authority

While Minnesota has not enacted a statewide ban on flavored tobacco or menthol, dozens of local jurisdictions have used licensing authority under Minn. Stat. 461.12 to restrict the sale of flavored products. Minneapolis, Saint Paul, Edina, and others limit flavored tobacco and menthol sales to adult-only tobacco shops or ban them outright. These ordinances have been upheld against preemption challenges because state law expressly allows stricter local regulation. Retailers must monitor local licensing terms in addition to state product registration rules.

Selling restricted flavored products in violation of a local ordinance can result in license suspension, fines, and revocation under municipal codes.
