Missouri Paid Leave Statewide Authority

RSMo 71.010, as amended, restricts political subdivisions from establishing employment benefit standards, including paid sick leave, family leave, vacation, and similar mandated benefits, that exceed state or federal law. The provision works alongside Missouri's broader pattern of preempting wage, scheduling, and benefit ordinances. Voters approved a statewide paid sick leave measure (Proposition A) in 2024, which establishes a uniform paid sick leave floor under RSMo Chapter 290. Localities may not stack additional accrual rates, eligibility expansions, or enforcement schemes on top of state law. Public employers retain the authority to provide leave to their own employees, and private employers may voluntarily exceed statutory minimums.

Local paid leave ordinances exceeding state law are unenforceable. Employers complying with state and federal benefit standards are protected from additional municipal mandates and penalties.
