Montana Marijuana Home Cultivation Statewide Limits

Under the Montana Marijuana Regulation and Taxation Act (Title 16, Chapter 12, MCA), adults 21 and older may cultivate up to two mature plants and two seedlings per person, with a household maximum of four mature plants and four seedlings regardless of how many adults reside there. Plants must be kept in a locked space and not visible from public view. Local governments cannot prohibit personal cultivation that complies with state law, although they may enforce reasonable nuisance standards. Renters remain subject to landlord prohibitions, and federally subsidized housing remains restricted.

Violations may result in civil penalties up to $250 for first offenses, plant seizure, and misdemeanor charges for cultivating beyond statutory limits.
