Montana Public Nuisance Law for Barking Dogs

Montana's nuisance statutes were restructured in 2025. MCA 27-30-101 now defines a public nuisance, while 27-30-106 defines a private nuisance, a condition that interferes with an individual's use and enjoyment of property. Persistent dog barking that substantially disturbs a neighbor fits the private-nuisance standard. A neighbor may bring a civil action under MCA 27-30-303 and obtain damages, abatement, or injunctive relief under 27-30-305. Counties and cities also adopt barking-dog ordinances, and most set specific duration or decibel thresholds beyond the general nuisance standard.
