Montana Plastic Bag Local Preemption Law

MCA 7-5-103 prohibits counties, cities, towns, and consolidated local governments from enacting ordinances that regulate the sale, use, distribution, or disposition of auxiliary containers, including plastic bags, paper bags, boxes, cups, bottles, and similar packaging. The law was passed to ensure statewide uniformity and protect retailers from a patchwork of local rules. Any local ordinance conflicting with the statute is unenforceable.

Local ordinances violating MCA 7-5-103 are void; aggrieved parties may seek declaratory or injunctive relief to invalidate enforcement.
