Montana Door-to-Door Sales and Cancellation Rights

Under MCA Title 30, Chapter 14, Part 5, Montana's Home Solicitation Sales Act provides buyers a three business-day right to cancel any consumer sale of $25 or more conducted at the buyer's home. Sellers must furnish a written contract in the buyer's primary language and a separate Notice of Cancellation form. The cancellation period runs from the date of sale or delivery of the cancellation notice, whichever is later. Failure to comply voids the contract and entitles the buyer to a full refund. These protections operate alongside Montana's Consumer Protection Act and apply uniformly statewide, even where municipalities impose additional permit or no-knock requirements.

Failure to provide cancellation notice voids the contract. Violations may also be unfair trade practices under MCA 30-14-103, allowing actual damages, attorney fees, and injunctive relief.
