Montana Tobacco Sales Age: 21 Under Federal Law

There is no Montana 'Tobacco 21' statute. Montana law, MCA 16-11-305 (sales) and 45-5-637 (possession), still sets 18 as the state minimum age for tobacco, alternative nicotine, and vapor products. However, the federal Tobacco 21 law, effective December 2019, prohibits sales to anyone under 21 nationwide, so Montana retailers must refuse sales below 21 regardless of the older state number. Retailers commonly verify photo ID for anyone appearing under 30. Penalties apply to retailers who sell to underage buyers.
