Montana Recycling Requirements: State-Government Mandate (§ 75-10-805)

The only statewide recycling requirement binds government itself. Section 75-10-805(1) directs each state agency, the legislature, and the university system to prepare a waste reduction and recycling plan, submit it to the Department of Environmental Quality, and recycle office and computer paper, cardboard, used motor oil, and used oil filters, while composting yard waste. A companion goal in § 75-10-803 targeted diverting 22% of Montana's solid waste by 2015 through recycling and composting. Section 75-10-806 also requires state purchasing specs favoring recycled paper, plastic, glass, tires, and motor oil. No provision requires residents or private businesses to recycle.

The statute carries no penalty clause. A state agency that skips its plan faces no fine, and Montana households and businesses have no recycling requirement or citation at all.
