Nebraska Tobacco 21 Minimum Age Statewide

Neb. Rev. Stat. 28-1418 makes it unlawful to sell, give, or otherwise furnish cigarettes, cigars, electronic nicotine delivery systems, alternative nicotine products, or other tobacco products to a person under 21 years of age. Retailers must check government-issued photo ID for any purchaser who appears under 30, and vending machine sales are confined to age-restricted venues. Section 28-1418.01 requires posted signs warning that sales to persons under 21 are prohibited. The state law mirrors the federal Tobacco 21 Act and applies uniformly across all counties, cities, and villages. Local jurisdictions may add complementary licensing or compliance check programs but cannot adopt a lower minimum age. Retailers caught in compliance check failures may also face license actions by the Department of Revenue.
