Nevada Rent Late Fee Rules

NRS 118A.210 allows a 'reasonable late fee for the late payment of rent as set forth in the rental agreement,' subject to two limits: 'In a tenancy that is longer than week to week, no late fee may be charged or imposed until at least 3 calendar days after the date that rent is due,' and 'such a late fee must not exceed 5 percent of the amount of the periodic rent.' The fee must be written into the lease to be enforceable, and the maximum may not be increased based on a previously imposed late fee — meaning fees cannot be stacked or compounded. A landlord who has not included a late-fee provision in the agreement may not charge one.

No specific statutory penalty. A late fee that exceeds 5 percent, is charged before the 3-day grace period, is compounded, or is not stated in the lease is unenforceable, and a tenant may contest or recover the improper charge.
