New Hampshire Alternative Treatment Center Licensing

RSA 126-X authorizes the Department of Health and Human Services to license a limited number of nonprofit Alternative Treatment Centers (ATCs) serving qualifying therapeutic cannabis patients. Each ATC may operate cultivation facilities and dispensaries in defined geographic regions. Statute requires dispensaries to be located at least 1,000 feet from primary or secondary schools. Municipalities retain zoning authority to designate appropriate districts but cannot ban ATCs operating consistently with state law in jurisdictions where licensed. There is no recreational dispensary framework, as adult-use cannabis remains illegal.

Operating without an ATC license, or violating siting and security rules, may result in license revocation, criminal charges, and closure orders.
