New Hampshire HOA & Condo Board Governance Rules

For condominiums, RSA 356-B:37 (Meetings) requires at least one association meeting yearly with "at least 21 days" advance notice for annual meetings, conduct under Robert's Rules unless bylaws say otherwise, and a "reasonable opportunity at any meeting to comment regarding any matter affecting the association." Minutes must be available "within 60 days of the meeting or 15 days of the date such minutes are approved," whichever is first. RSA 356-B:35 requires bylaws fixing the board's election, terms, and powers, and states "the board of directors shall have a fiduciary relationship to members." RSA 356-B:37-e compels disclosure of profit-and-loss statements, budgets, and financial records on request. For non-condo HOAs, governance comes from the bylaws under RSA 292, including a 2/3 vote to amend bylaws or budgets after developer control ends where one person holds over 50% of the votes (RSA 292:8-m).

No specific statutory penalty. Owners enforce open-meeting, records, and fiduciary duties through RSA 356-B:15 suits (condos) or RSA 292 nonprofit remedies (non-condo HOAs).
