New Mexico Tiny Home Building Code Standards

Under NMSA Chapter 60, Article 13 (Construction Industries Licensing Act), the New Mexico Regulation and Licensing Department's Construction Industries Division (CID) adopts and enforces a uniform statewide building code based on the IRC. New Mexico has incorporated IRC Appendix Q, which provides specific allowances for tiny houses 400 square feet or less, including reduced ceiling heights in lofts, ladder access, and emergency egress modifications. Local jurisdictions may not impose stricter structural code requirements than the state-adopted code. Zoning, however, remains a local matter and can affect minimum dwelling size in residential zones.

Constructing a tiny home without a CID permit or in violation of the IRC may result in stop-work orders, civil penalties, and inability to obtain a certificate of occupancy under NMSA 60-13-52.
