New Mexico Limited Firearms Preemption Statute

Under NMSA 1978 Section 14-2-9, the legislature has reserved most firearms regulation to the state, preempting counties and municipalities from passing inconsistent ordinances. However, New Mexico's preemption is narrower than many states: localities retain authority over discharge regulations, may restrict carry on certain government property, and can enact zoning rules that incidentally affect firearms businesses. The state constitution under Article II, Section 6 also provides specific carve-outs allowing municipalities and counties to regulate the carrying of concealed weapons on their own premises.

Local ordinances that conflict with state firearms law are subject to legal challenge and may be enjoined or invalidated by courts.
