North Carolina Tobacco Flavor Restrictions Status

Unlike several states that have prohibited menthol cigarettes or flavored e-cigarettes, North Carolina law currently permits the sale of flavored tobacco and vapor products to adults 21 and older, subject to federal FDA premarket authorization rules. State preemption under NCGS 14-313 limits local authority to enact flavor-specific bans, though municipalities can use zoning and licensing in narrow ways. Federal rules from the FDA prohibit certain flavored cartridge-based e-cigarette products but exempt open-system vape liquids and disposable devices.

Selling flavored products that lack required FDA marketing authorization can result in federal enforcement and seizure; state-level enforcement focuses on age compliance.
