North Dakota Floodplain Management and NFIP Compliance

NDCC Chapter 61-16.2 designates the Department of Water Resources as the state coordinating agency for the National Flood Insurance Program (NFIP). Communities mapped with Special Flood Hazard Areas must adopt floodplain ordinances meeting FEMA minimums to remain eligible for federal flood insurance. State law requires elevation of new structures above base flood elevation, restrictions on substantial improvement of existing structures, and permits for development in floodways. Levee certification, channel modifications, and obstruction permits are administered by the State Engineer. Cities and counties may adopt stricter standards.

Non-compliant construction may trigger FEMA suspension from NFIP, denial of flood insurance, and state enforcement orders requiring removal or elevation of structures.
