Oklahoma Prohibits Breed-Specific Dog Bans

Under 4 O.S. Section 46.1, Oklahoma cities, towns, and counties may not adopt or enforce ordinances that regulate dogs based on breed. This statewide preemption was enacted to prevent breed-specific legislation (BSL) targeting pit bulls or similar breeds. Municipalities retain authority to declare individual dogs dangerous based on behavior, require dangerous dog registration, and enforce leash and confinement rules, but any blanket breed prohibition is invalid under state law. Existing local breed bans are unenforceable, and dog owners cannot be cited solely because their dog belongs to a particular breed.

Cities enforcing breed-specific bans expose themselves to civil suit. Owners cited under invalid breed ordinances may challenge the citation in court.
