Oklahoma Minimum Wage Preemption Bars Local Increases

Under 40 O.S. 160 and the Oklahoma Minimum Wage Act, the regulation of minimum wage, vacation, and other employment conditions is reserved to the state. Municipalities may not enact ordinances establishing a local minimum wage above the state minimum, currently aligned with the federal $7.25 per hour rate. The preemption was strengthened after Oklahoma City voters considered raising the city minimum, prompting a statewide measure ensuring uniform wage rules across all 77 counties. Tipped employees follow federal tip credit rules.

A municipal ordinance imposing a higher local minimum wage is preempted and unenforceable, and employers need only meet the state and federal floor.
