Rhode Island Polystyrene Foam Container Restrictions

Unlike its plastic bag law under RIGL Chapter 23-92, Rhode Island has not enacted a statewide ban on expanded polystyrene foam food containers and packaging. Several cities, including Providence and Newport, have adopted local restrictions on polystyrene takeout containers, cups, and trays, particularly for food service establishments and city-permitted events. The Department of Environmental Management promotes voluntary alternatives and may regulate certain packaging through extended producer responsibility frameworks. Legislative proposals to ban polystyrene statewide have been introduced but not yet enacted into law.

Where local polystyrene ordinances apply, food service establishments using prohibited foam containers face municipal civil penalties; statewide enforcement is currently limited to voluntary measures.
