Unlike several states, South Carolina does not prohibit flavored cigarettes, cigars, or vapor products beyond federal restrictions on flavored cigarettes and FDA enforcement against unauthorized flavored e-cigarettes. The General Assembly retains primary authority over tobacco product regulation under Title 16, Chapter 17 and Title 12 licensing. Localities considering flavor restrictions may face preemption arguments under the comprehensive state framework. Federal law continues to ban most flavored cigarettes other than menthol and regulates electronic nicotine delivery systems through FDA premarket review.
