South Dakota state law: driveway access and blocking

South Dakota state law addresses driveways in two distinct ways. (1) On-street parking: SDCL Chapter 32-30 (Stopping and Parking) prohibits stopping, standing, or parking a vehicle in front of a public or private driveway in a manner that obstructs ingress or egress. Violation is a traffic infraction; the vehicle may be removed under SDCL 32-30-12 et seq. and processed as abandoned if left longer than 24 hours (or any shorter window set by municipal ordinance under SDCL 32-30-12.1). (2) Driveway access: any new or modified driveway accessing a South Dakota state trunk highway or state-aid highway requires an entrance permit from the South Dakota Department of Transportation (SDDOT) under SDCL Chapter 31-28 (Streets and Highways — Access Control). SDDOT entrance permits address sight distance, drainage, culvert sizing, intersection spacing, and surface conformance. Driveway access onto a city street is permitted by the municipal Public Works or Engineering department under the local Access Ordinance, adopted under SDCL 9-29-1 (statutory cities) or SDCL 6-12 home-rule charter (Sioux Falls, Rapid City, Watertown). Residential driveway width minimums, paving/surface standards, maximum number of curb cuts per lot, and shared-driveway rules are set entirely at the local level under SDCL Chapter 11-4 (municipal zoning) or SDCL Chapter 11-2 (county zoning). South Dakota does NOT impose a statewide minimum residential driveway width.

Blocking a driveway under SDCL Chapter 32-30 is a traffic infraction; the vehicle may be towed at the owner's expense. Constructing a driveway onto a state highway without an SDDOT entrance permit is a civil violation and may require removal or remediation. Municipal driveway-access ordinance violations are enforced by the local Code Enforcement Officer or Building Official with typical $100-$500 fines and orders to comply.
