South Dakota Tobacco 21 Minimum Age Law

SDCL 34-46-2 makes it unlawful to sell, give, or furnish tobacco products, including cigarettes, cigars, smokeless tobacco, and vapor devices, to any person under 21. Retailers must verify ID for purchasers appearing under 30. Although state penalties historically applied at age 18, federal law and enforcement now require Tobacco 21 compliance. Possession by minors remains separately addressed under SDCL 34-46-5.

Furnishing tobacco to a minor is a Class 2 misdemeanor with fines up to $500; repeat retailer violations can result in license suspension or revocation.
