Vermont Construction Erosion and Sediment Control Standards

Under 10 V.S.A. Section 1264 and the Vermont Construction General Permit, any earth disturbance of one acre or more, or smaller sites that are part of a larger common plan of development, must implement an Erosion Prevention and Sediment Control plan meeting the Low Risk Site Handbook or full engineered standards. The Agency of Natural Resources sets uniform best management practices including silt fencing, stabilized construction entrances, dewatering controls, and stabilization timelines. Operators must self-inspect and submit notices of intent. Local ordinances may add procedural review but cannot weaken state erosion control standards or exempt regulated projects.

Sediment discharges, plan failures, or unpermitted disturbance can trigger stop-work orders and penalties up to $42,500 per day under 10 V.S.A. Section 8221.
