Wyoming Bars Marijuana Dispensaries Under State Law

Wyoming Statutes 35-7-1031 and 35-7-1036 criminalize the delivery, sale, and possession with intent to deliver marijuana. Without a state authorization scheme, no licensing pathway exists for medical or recreational dispensaries. Local zoning ordinances cannot create what state law forbids; any municipality that attempted to license a dispensary would be in conflict with state criminal law. CBD products derived from federally compliant hemp containing less than 0.3 percent THC may be sold by general retailers, but THC-content cannabis storefronts remain illegal. Wyoming voters have considered ballot measures, but as of the current statute, dispensaries are not authorized.

Operating a marijuana dispensary is felony delivery under W.S. 35-7-1031, with sentences up to 20 years for repeat or quantity-aggravated offenses, plus federal exposure.
