Wyoming County Fire Restriction Authority Statute

Under W.S. 35-9-301 through 35-9-304, Wyoming county commissioners may close areas to fire activity when drought or excessive fuel loads create extreme fire danger. Closures must be published and may restrict open flames, smoking, fireworks, and motorized equipment. Effective January 1, 2022, Wyoming adopted the 2021 International Wildland-Urban Interface Code (IWUIC) as the statewide minimum. Local jurisdictions may amend codes to be more restrictive but cannot weaken the state baseline. Violation of a posted closure under W.S. 35-9-304 carries a fine up to $100 or imprisonment, in addition to liability for suppression costs caused by negligent ignition.

Violating a county fire closure is punishable by a fine not exceeding $100 or imprisonment under W.S. 35-9-304. Negligent wildfire starters face civil liability for suppression costs.
