Wyoming Requires Annual License for Every Public Pool and Spa

Wyoming Statutes Title 35, Chapter 28 governs public pools and spas. Under section 35-28-108, an operator pays a $100 initial license fee ($50 to renew), and all licenses expire June 30 each year. The Department of Agriculture and the Department of Health run the safety program; where a local health department exists, it issues the licenses and conducts enforcement. Inspectors may enter any pool at reasonable times, and no facility receives fewer than one inspection per year (section 35-28-107). A regulatory authority may summarily suspend a license, without a prior hearing, when an imminent health hazard exists such as sewage backup, waterborne illness, or extended loss of water service (section 35-28-109).

Knowingly and intentionally violating the act or its regulations is a misdemeanor punishable by up to six months imprisonment, a fine of up to $750, or both (section 35-28-105). Operating a public pool or spa without a valid license is prohibited.
