Sahuarita requires street vendors to register with the Town Clerk and obtain both a street vendor license with an identification card and a separate general business license under Chapter 5.15 of the Town Code before conducting any vending activity within town limits. Each separate trade, calling, profession, or business activity conducted by the same person as a street vendor requires its own individual license and fee payment. The license may be denied, restricted, suspended, or revoked for fraud in the application, violations of the chapter or other Town ordinances, violations of state or federal law, or when the Town determines that action is necessary in the interest of public safety and protection of the community.
Chapter 5.15 of the Sahuarita Town Code establishes the complete permit framework for street vending within the Town corporate limits, creating a dual licensing requirement that ensures both vending-specific and general business regulations are applied to street vending operations. Any person intending to operate as a street vendor in Sahuarita must first register with the Town Clerk office and obtain a street vendor license along with an identification card that displays the vendor registration information. This identification card must be carried by the vendor at all times during vending operations and presented upon request to law enforcement officers or Town code enforcement personnel. In addition to the street vendor license, all vendors must also obtain a standard general business license under Title 5 of the Town Code, which applies to all commercial activity conducted within Sahuarita regardless of the type of business. When a single vendor engages in more than one distinct trade, calling, profession, occupation, or business activity as a street vendor, the code requires a separate street vendor license and separate fee payment for each distinct activity. This means that a vendor who sells both food items and non-food merchandise would need two separate street vendor licenses in addition to the general business license. The Town Clerk has authority to deny, restrict, suspend, or revoke a street vendor license for any of several grounds, including fraud or material false statements in the license application, violation of Chapter 5.15 or any other Town ordinance, violation of applicable state or federal law, or when the Town determines that denial or revocation is warranted in the interest of public safety and protection of the community. Arizona state law under ARS 9-485.01 also establishes statewide standards for mobile food vendors and mobile food units that Sahuarita must comply with and cannot impose regulations more restrictive than the state framework in certain areas. Vendors selling food must additionally obtain applicable Pima County Health Department food handler and mobile food unit permits and comply with Arizona Department of Revenue transaction privilege tax registration and reporting requirements.
Operating as a street vendor without the required license is a violation of Town Code Title 5 and Chapter 5.15. License suspension or revocation for code violations, false application statements, or public safety concerns. State penalties may apply for food safety violations through the Pima County Health Department. Transaction privilege tax violations enforced by the Arizona Department of Revenue.
