Buena Park treats above-ground and on-ground pools the same as in-ground pools: a building permit, the 60-inch barrier, and the Pool Safety Act features all apply. Special rules cover barriers mounted on the pool wall and ladder/step access, which must be secured or barriered.
The City of Buena Park pool handout defines a swimming pool to include in-ground, above-ground, and on-ground pools (plus hot tubs, spas, portable spas, and non-portable wading pools) holding water over 18 inches deep, so above-ground pools need the same building permit and barrier. The barrier must be at least 60 inches tall on the outside. For above-ground pools, where the top of the pool structure is above grade the barrier may sit at ground level or be mounted on top of the pool structure; where mounted on top, the maximum clearance between the pool structure top and the barrier bottom is four (4) inches (versus two inches at grade). Critically, where an above-ground pool structure itself serves as the barrier and access is by a ladder or steps, that ladder or steps must be surrounded by a complying barrier, or be securable, lockable, or removable so that when secured no opening allows a 4-inch sphere to pass. Like all pools, above-ground pools at single-family homes must include at least two of the seven Pool Safety Act drowning-prevention features and meet setback rules (5 feet from water's edge to side/rear property lines). Mechanical equipment, electrical bonding/grounding, and GFCI protection rules also apply. The handout notes its provisions are general; additional requirements come from the California Building, Plumbing, Mechanical, and Electrical Codes.
Installing an above-ground pool without a permit or complying barrier; leaving ladder/step access unsecured so a child can climb in. Approval to fill is withheld until barrier requirements are met.
