The County defines a private swimming pool to include in-ground, on-ground, and above-ground pools, so the same Section 1002.C rules apply: a zoning permit, a 10-foot side/rear setback, and a fence at least four feet high enclosing the pool. The NC Residential Code barrier appendix (AG105.2) allows an above-ground pool structure itself to act as the barrier when at least 48 inches tall, or a barrier mounted on top of the structure, in which case the gap between the pool top and the bottom of the barrier may not exceed four inches. Any ladder or steps must be removable, lockable, or separately barriered.
An above-ground pool without a compliant barrier or required permit is a code violation subject to correction orders and civil penalties.
