Cumberland County requires a fence at least four feet high to completely enclose the yard area holding a pool, with a securely fastening gate for below-ground pools. Fence spacing may not exceed four inches and must meet the current NC State Building Code guard-opening limits.
Section 1002.C.2 of the County Zoning Ordinance sets the barrier rule: a minimum four-foot fence must fully enclose the portion of yard containing the pool, and below-ground pools need a gate that can be securely fastened. Horizontal and vertical spacing in the fence is capped at four inches, and the barrier must at minimum satisfy the guard-opening spacing limits of the most currently adopted North Carolina State Building Code (the IRC-based residential barrier standard). This local rule works alongside the state Residential Code pool-barrier appendix, which requires the barrier to be at least 48 inches high measured from the outside.
A pool without a compliant enclosing fence fails inspection and the zoning permit will not be finalized; the County can require correction and assess civil penalties.
