Florida Statute 515.25 defines a residential swimming pool to include in-ground, aboveground, and on-ground pools with water over 24 inches deep, so above-ground pools are not exempt from the Residential Swimming Pool Safety Act. The pool wall itself can serve as part of the barrier only if it is at least 4 feet high and any ladder or steps are removable or lockable so a child cannot climb in. A county building permit under the Florida Building Code is required, and screen enclosures must be at least five feet from side and rear property lines per the Land Development Code.
Same as in-ground pools: a new pool without a qualifying safety feature is a second-degree misdemeanor (FS 515.27(2)); county code enforcement handles permit and setback issues.
