Escambia County's Nuisance Abatement Ordinance (Code ch. 42, art. VI) treats overgrown weeds, grass, and shrubbery as a nuisance in the unincorporated county. Property owners must remove the growth; there is no set height number.
Article VI, titled the County Nuisance Abatement Ordinance, applies only in the unincorporated county. Section 42-196 lists nuisance conditions including overgrowth on residential and commercial land; section 42-197(c) prescribes removal of all nuisance conditions. Rights-of-way, government land, agricultural land, and undeveloped one-acre-plus parcels kept in a natural vegetative state under a recorded affidavit are exempt. The City of Pensacola enforces vegetation nuisances within its limits under its own code.
The Office of Code Enforcement investigates and issues citations under section 42-198, following the section 42-164 procedure. The owner is liable once the nuisance has existed at least 48 hours.
