Hot tubs and nonportable spas holding water over 24 inches deep are 'residential swimming pools' under Florida law. An approved safety pool cover satisfies the safety-feature requirement for a hot tub.
Florida Statute 515.25 expressly includes hot tubs and nonportable spas with water over 24 inches deep in the definition of a residential swimming pool, so they fall under the Residential Swimming Pool Safety Act. The simplest way to comply is FS 515.27(1)(b): the pool must be equipped with an approved safety pool cover. Alternatively a hot tub can be enclosed by a compliant barrier or protected by alarms. Portable, plug-in spas with a lockable hard cover are generally treated as portable and are not 'nonportable' spas, but a county building permit is required for hardwired or built-in installations.
A new spa or hot tub over 24 inches deep without a qualifying safety feature is a second-degree misdemeanor under FS 515.27(2).
