Above-ground pools in Leander require a building permit and the same safety barrier as in-ground pools: a minimum 4-foot fence, a 54-inch self-latching gate, and alarms on doors leading from the house to the pool. Plans showing the pool's location to property lines and PUEs must be submitted.
The City of Leander's Swimming Pool Submittal Packet addresses above-ground pools specifically. For above-ground pools, the applicant must submit a plot plan showing the location of the pool relative to the home, property lines and public utility easements (PUEs); any applicable plumbing and electrical details; a minimum fence height of 4 feet and a minimum self-latching gate height of 54 inches shown on the plot plan; and alarms on any door leading from the house to the pool (the audible alarm must be separate from the home security system and displayed on the plan). The same enclosure standards in Code of Ordinances Sec. 3.03.042 apply to above-ground pools as to in-ground pools, including the four-foot (48-inch) minimum enclosure height, the prohibition on openings passing a six-inch sphere, self-closing/self-latching gates, and the prohibition on chain-link for new enclosures constructed after January 1, 1994. The Code does not exempt above-ground pools from the enclosure requirements. Leander's adopted 2021 International Residential Code (Sec. 3.03.034) includes Appendix G covering swimming pools, hot tubs and spas. Note that the pool wall of an above-ground pool may serve as part of the barrier only to the extent it meets the adopted code requirements; applicants should confirm specifics with Development Services during plan review.
Installing an above-ground pool without a permit and complying barrier prevents Building Final inspection approval. Building-code violations are a misdemeanor punishable by a fine up to $2,000.00 (Sec. 3.03.001).
