Fireworks are illegal inside Leander city limits. City Code sec. 5.04.004 bars any person from possessing, storing, selling, giving away, using, transporting or manufacturing explosives or fireworks within the city's fire limits. Violations are a misdemeanor punishable by fines up to $2,000. Consumer fireworks remain legal only in unincorporated Williamson County.
The City of Leander prohibits fireworks throughout its corporate limits. Under City Code section 5.04.004, no person may possess, keep, store, sell, offer for sale, give away, use, receive, transport or manufacture any explosives or fireworks within the fire limits or boundaries of the City of Leander. The fire marshal, with approval of the city administrator, may issue a special written permit for a supervised fireworks or explosives display within the fire limits, setting the conditions under which the display may be conducted. Explosives and fireworks located within the fire limits are declared a public nuisance. The ordinance also makes it an offense to encourage or assist anyone under 18 in possessing or discharging fireworks. This city ban is more restrictive than Texas law, which under the Occupations Code permits consumer fireworks use in many unincorporated areas; cities are authorized to prohibit fireworks within their limits. Williamson County provides an interactive GIS map so residents can confirm whether a location falls inside city limits (where fireworks are banned) or in an unincorporated area where they may be legal when no county burn ban is in effect.
Any person violating any provision of the fireworks article is guilty of a misdemeanor and, upon conviction, may be fined up to $2,000. Fireworks within the fire limits are also declared a public nuisance subject to abatement. Encouraging or assisting a minor in possessing or discharging fireworks is a separate offense. Police may seize illegal fireworks.
