Under Article 5.05 of the Cedar Park Code of Ordinances, it is unlawful for any person to sell, possess, store, use, or explode any fireworks within the corporate limits of the City, and unlawful for any person to possess, store, use, or explode any fireworks within 5,000 feet outside the corporate limits. The ordinance is enforced by both the Cedar Park Fire Marshal and the Police Department year-round, including New Year's Eve and the Fourth of July. The Fire Marshal is authorized to issue display permits to qualified pyrotechnic operators for supervised public displays; applications must be filed in writing at least 10 days in advance of the display, accompanied by a $250 display permit fee. Texas Occupations Code Chapter 2154 (Fireworks) and the State Fire Marshal's regulations apply statewide outside the city's ban zone.
Violation is a Class C misdemeanor under Article 5.05. Maximum fine is $2,000 per offense, plus court costs. Each unlawful discharge can be charged as a separate offense.
