A landlord who fails to install, inspect or repair required smoke alarms can face tenant remedies under Texas Property Code sec. 92.259-92.260, including a court order, actual damages, a civil penalty, attorney's fees and potentially lease termination. Fire-code smoke-alarm requirements for new construction are enforced through Leander building permits and inspections under the adopted 2021 IFC.
