Leander's zoning ordinance exempts fence construction from a site development permit, and fences not over seven feet are exempt from a building permit under the adopted 2021 IRC. A retaining wall, however, is not exempt and requires review.
Leander does not list fences among the work items requiring a permit on its 'Do I Need a Permit?' page, and the Composite Zoning Ordinance expressly exempts 'construction of a fence' from the site development permit requirement (Article VIII, site development chapter). However, that same provision states no exception is granted for construction of a retaining wall or for a fence that may obstruct or change the flow of water. For building-permit purposes, Leander has adopted the 2021 International Residential Code and 2021 International Building Code; under the standard IRC/IBC exemptions a fence not over seven feet high does not require a building permit, while taller fences and most retaining walls over four feet do. Regardless of whether a permit is pulled, fences must still meet all zoning standards in Article VI, Section 16: height limits, finished-side orientation, concrete post footings, structural integrity, and material rules. Because the city's published permit list is not comprehensive, Development Services advises confirming with a building inspector before starting work. A guardrail is required by the city's building-code amendments for any wall greater than forty-eight inches in height with a walkable surface to the wall.
Building a fence that violates zoning standards, or a retaining wall or water-obstructing fence without the required review, can trigger stop-work orders, mandatory correction, and code-enforcement penalties.
