Leander's pool safety requirements combine the Code of Ordinances, the adopted 2021 International Swimming Pool and Spa Code, and the City's Swimming Pool Submittal Packet. Sec. 3.03.042 requires self-closing and self-latching gates and a complying enclosure, and adopts the openings and climbability standards (no readily climbable permanent equipment placed against the enclosure). The Code (Sec. 3.03.034) adopts the 2021 International Residential Code including Appendix G, Swimming Pools, Hot Tubs and Spas. Under the Composite Zoning Ordinance, Article IV, Section 5, swimming pools and similar recreational facilities must be located to the rear of the primary residence, and swimming pool pumps, filters and related equipment must be located or screened so as to be concealed from view of adjacent streets and lots. Where any provision of the 2021 ISPSC conflicts with state law on pool operation, management, water quality, safety standards unrelated to design and construction, signage or enclosures, Sec. 3.03.001 provides that the state law or regulation controls (Texas Health and Safety Code Chapter 757 governs pool yard enclosures).
Failure to provide required alarms, self-latching gates or a complying barrier prevents the pool from passing Building Final inspection. Building-code violations are punishable by a fine up to $2,000.00 (Sec. 3.03.001).
