Two layers of regulation apply to pool barriers in Albany. The statewide floor is set by NYS Residential Code Β§R326 (formerly Appendix G), which requires a barrier at least 48 inches (4 feet) above grade on the outside of the barrier, with no openings greater than 4 inches, no horizontal members that create a climbable foothold within the bottom 45 inches, and gates that are self-closing and self-latching with the release mechanism at least 54 inches above the ground. Β§R326 applies to every outdoor residential pool capable of holding water more than 24 inches deep, including most above-ground pools.
On top of that statewide floor, the City of Albany requires a 6-foot fence enclosing the pool. According to the City of Albany Planning Department's pool FAQ, "Swimming pools are permitted as accessory structures only" and "a 6 foot fence that encloses the pool is required." The pool itself must sit in the rear yard, at least 6 feet from any side lot line and at least 10 feet from any rear lot line. These are use-specific standards administered under USDO Β§375-303 and enforced by the Albany Department of Buildings and Regulatory Compliance, which reviews fence plans as part of the pool permit application.
Practical implications: a 48-inch fence that satisfies Β§R326 alone will NOT satisfy Albany's 6-foot requirement and will fail inspection. Plan for a 72-inch fence, climb-resistant face on the outside, no decorative footholds within the lower 45 inches, and a self-closing, self-latching gate latched at least 54 inches above grade. A house wall may serve as part of the barrier only if any door leading directly to the pool area has an alarm or a self-closing/self-latching device meeting Β§R326.7.
Operating an unfenced residential pool, or one fenced below the 6-foot Albany standard, is a violation of USDO Β§375-303 and the NYS Uniform Code as locally enforced. The Albany Department of Buildings and Regulatory Compliance can issue stop-work orders, deny or revoke a Certificate of Compliance, impose daily fines, and order the pool drained or removed. Beyond municipal penalties, an inadequately fenced pool exposes the homeowner to civil liability under the New York "attractive nuisance" doctrine if a child gains access.
