Residential pools and non-self-contained spas in unincorporated San Luis Obispo County must be enclosed by a permanent, non-removable barrier at least 60 inches tall before they can be filled with water, per CBC Section 3109 and County Code 15.04.320.
County handout BLD-1054 (07/09/2024) implements the California Swimming Pool Safety Act (Health and Safety Code Section 115922-115923) and CBC Section 3109 for unincorporated areas. The enclosure must be at least 60 inches above grade measured from the outside (the side facing away from the pool), have no more than 2 inches of vertical clearance between the ground and the bottom of the barrier, and have no gaps that allow passage of a 4-inch sphere. The outside surface must be free of handholds or footholds that a child under five could use to climb. Access gates must open away from the pool, be self-closing and self-latching, with the latch placed no lower than 60 inches above the ground. Non-pedestrian gates must be lockable and kept locked when not in use, with a permanent sign reading 'This access to be kept locked at all times.' Driveway gates that form part of the enclosure must be electronically operated and auto-close within one minute. Self-contained spas with an ASTM F1346-91 locking safety cover are exempt from the fence requirement.
Building inspector will not approve final inspection and the pool cannot be filled with water until a compliant enclosure is in place. Maintaining the enclosure is the ongoing responsibility of the owner/occupant per BLD-1054. Failing or absent barriers can also expose the owner to civil liability under the Swimming Pool Safety Act.
