Pool fencing in Kern County is governed by the California Swimming Pool Safety Act (Health & Safety Code §§115920-115929) and California Building Code §3109, both adopted countywide through Kern County Code Title 17. Pools deeper than 18 inches require a barrier at least 60 inches high with self-closing, self-latching gates whose latches sit at least 60 inches above grade. New pools and remodels must include at least two of seven approved drowning prevention features.
Per HSC §115923, a permanent enclosure around a private single-family swimming pool must be at least 60 inches high, with no more than 2 inches of vertical clearance above grade and no openings that allow passage of a 4-inch sphere. Gates must open away from the pool and be self-closing and self-latching, with the release at least 60 inches above the ground. The exterior of the barrier must be free of handholds or footholds that could aid climbing. HSC §115922 requires that whenever a building permit is issued for a new pool, spa, or qualifying remodel at a single-family home, the pool be equipped with at least two of seven approved drowning prevention features: (1) a compliant enclosure; (2) removable mesh fencing meeting ASTM F2286 with self-closing/self-latching gate; (3) an ASTM F1346 safety cover; (4) exit alarms on doors leading to the pool; (5) self-closing/self-latching devices on those doors with a release at least 54 inches above the floor; (6) an ASTM F2208 in-water alarm; or (7) other equivalent protection independently verified. Kern County issues pool permits through Planning & Natural Resources / Building Inspection under Title 17 of the County Code, which adopts the California Building Code including CBC §3109. The Pool Safety Act does not apply to public pools, hot tubs/spas with compliant locking covers, or multifamily complexes.
Construction without a permit, or final inspection of a pool lacking the 60-inch barrier and two required drowning-prevention features, can be denied final approval and require corrective work. Unsafe pools may also be enforced as a public nuisance by Kern County Public Health Services.
